General terms and conditions of XCLUSIVE SNAKES

§1 Validity to companies and definitions

(1) The following terms and conditions are applied to all transactions between us and a consumer. They become valid by the time of placing the order.

(2) A “consumer” is – in the sense of these terms – any natural person entering a purpose transaction which cannot be attributed neither to a commercial or independent professional practice.

 

§2 Conclusion of contract, contract storage

(1) The following rules on the conclusion of contract apply to any orders via our online shop “www.xclusive-snakes.de”.

(2) In case of a contract conclusion, the contract is concluded with

(3) The presentation of goods in our online shop is not a legally binding contract offer from our side, but is only a non-binding invitation for potential customers to order goods. By placing the order, the consumer makes a binding offer for him. He then is concluding a purchase contract.

The acceptance of the order is being made in text form or by sending the goods within one week. The order is rejected when the deadline expires without acceptance.

(4) The following rules apply upon a receipt of an order via our online shop: By successfully passing through our ordering procedure in our online shop, the consumer makes a binding contract offer.

The ordering procedure consists of the following steps:

1) Selection of the desired goods

2) Confirmation by clicking the “Order” button

3) Verification of the information in the shopping cart

4) Confirmation by clicking the “Checkout” button

5) Sign-in at the shop after registration and after entering the sign-in information (email and password).

6) Repeated validation and correction of the particular input-data.

7) Mandatory sending of the order (placing the order).

 

Before the mandatory placement of the order the consumer has the opportunity to get to the webpage the particular data is being entered and possibly corrected, by clicking on the “back” button in his web browser or by closing it, which will cancel the order process. The receipt of the order is acknowledged by us immediately via an automatically generated email (confirmation of receipt). This email does not constitute the acceptance of the offer. The acceptance is being made in text form or by sending the ordered goods within one week.

(5) Storage of the contract for purchase via our online shop: We save the contract text and send the order data and the terms to you by email. The terms and conditions are also always available on our webpage. Your past orders can be seen by you in our customer area under “My account” → “My orders”.

 

§3 Prices, shipping costs, payment, maturity

(1) The prices include VAT and any other price components, exclusive possible shipping costs.

(2) The consumer has the option of paying in advance, cash or by credit card (VISA, Mastercard).

(3) When the consumer has chosen payment in advance, he commits himself to pay the purchase price immediately after contract conclusion.

 

§4 Delivery

(1) If we have not stated clearly in the product description, all products we offer can be shipped immediately. For living animals there are other conditions applied than for accessories.

(2) If the consumer has chosen payment in advance, we will not send the goods before receiving the payment.

 

§5 Retention of title

We reserve title to the goods until full payment of the purchase price.

§6 Withdrawal

Right of withdrawal

Withdrawal

You have the right to withdraw this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the date on when you or a representative of your choice, which is not the carrier, had/has taken possession of the goods.

by an unambiguous statement (e.g. a letter (post mail), fax or an e-mail) of your decision of a withdrawal from this contract. You can do so with the attached withdrawal form which is, however, not mandatory. You can also electronically fill out and transmit the withdrawal form or any other unequivocal statement on our webpage (www.xclusive-snakes.de). When making use of this option, we will immediately send you a confirmation of withdrawal reception (e.g. by e-mail). To meet the withdrawal deadline, it is sufficient sending your message about the exertion of withdrawal before the end of the withdrawal period.

 

Withdrawal effects

If you withdraw from this contract, we will reimburse all payments we have received from you immediately and latest within two weeks from the day we have received your cancellation of the particular contract. This includes the costs of supply (with the exception of any additional costs arising from the fact that you have chosen another type of delivery than the salutary standard delivery offered by us). For this repayment we use the same payment method you used in the original transaction, unless you agreed otherwise explicitly; in any case you will not be charged fees for this repayment.

We may withhold reimbursement until we have received the goods again or until you have given us proof the goods were returned – whichever is earlier. You have to return the goods immediately and in any case latest within fourteen days from the day you informed us about withdrawal. The deadline is met if you send the goods before this fourteen day period. You bear the direct accumulating costs of returning the goods. You only need to pay for a potential diminished value of the goods, when it is caused by a not necessary handling from you considering the examination for nature, characteristics and functioning.

 

Right of withdrawal exclusion

 

This right does not apply to contracts

- for the delivery of goods which are not prefabricated and for their production an individual choice or decision is required or which are clearly tailored to the personal needs of the consumer.

- for the delivery of goods which can spoil fast or whose expiration date would be exceeded fast.

- for the delivery of sealed goods, which are not suitable for return due to reasons of health protection or hygiene and whose sealing is removed after delivery.

- for the delivery of goods which are mixed up with other goods inseparable due to their material properties.

- for the delivery of alcoholic goods, whose price had been arranged by the contract but which can earliest be delivered 30 days after contract conclusion and whose current value depends on market fluctuations out of the entrepreneur's control.

- for the delivery of audio or video material or computer software in a sealed package, whose sealing was removed after delivery.

- for the delivery of newspapers, magazines or pictorials with the exception of subscription contracts.

§7 Contract language

German is exclusively available as contract language.

 

§8 Warranty rights

Warranty animal purchase

We only sell animals that have eaten independently several times before delivery. By the time of delivery, every animal we sell is in an optically faultless and healthy condition to the best knowledge. No warranty is assured for internal or unrecognisable diseases. The future owner certifies the animal has been examined detailed, in case of distance selling with photos, date of eclosion and other information and that he will not plead claims.

After leaving our premise, no matter if animal delivery, pick-up or transfer in Hamm or in any other location, we cannot take responsibility for later occurring diseases or even for the loss of the animal.

Considering delivery of living animals we can only accept written orders (with setting the particular hook accepting the terms in the ordering process) or the immediate acceptance after arrival due to legal reasons. 

All animals are excluded from return or restitution after leaving our premises.

Sexing was performed to the best knowledge but cannot be guaranteed. Nevertheless, please write to us if it turns out an animal was determined incorrectly.

The buyer/future owner agrees to these terms and conditions and makes this explicit by accepting our terms.

 

§9 Arbitration

Please keep in mind that you purchase an animate being and that you are therefore responsible for a species-appropriate husbandry. For questions, tips and advice we are furthermore happily available.

The European Commission provides a platform for online dispute resolution (OS), which is available here http://ec.europa.eu/consumers/odr/. Consumers have the opportunity to use this platform for the settlement of their dispute.
